Filing your RJI and Application upon Commencement
When submitting an Application such as a proposed OSC or Ex parte order upon Commencing an action or proceeding, be sure to select the correct document type to avoid being charged for the application. Law provides that there is no applicable fee for the application when filed with the commencement document(s). For example: If commencing a special proceeding by filing a Petition with Proposed Order to Show Cause, you should select the Petition as your commencement document and as an accompanying document choose the document titled ” Proposed Order to Show Cause Accompanying Commencement Document” this will prevent a separate fee being charged for the application. You should answer yes to the question “will you be filing a request for judicial intervention at this time?” at the top of the File Documents page. In the above example your total charge will be $305, $210 for the index fee and $95 for the RJI fee.
Reminder to Serve the proper E-Filing Notice upon Commencement
E-Filing rules require that a party commencing an e-filed action must serve a hard-copy notice regarding electronic filing with the commencement documents. The specific type of notice depends on the nature of the e-filed action. In a mandatory e-filed action, the commencing party must serve the Notice of Commencement of Action Subject to Mandatory Electronic Filing (Form EFM – 1). In a consensual e-filed action, the commencing party must serve a Notice Regarding Availability of Electronic Filing (Form EF – 3). The NYSCEF system will offer you an opportunity to print the proper notice on your thank you page after filing your documents. Both forms are also available on the Forms page which is located under the Resources tab.
Returned Document
If a document is returned to you for correction please DO NOT FILE IT AS A NEW DOCUMENT. To Re-File a corrected document -from the Main Menu go to “MY CASES”, click on the index number, and Click the link titled “Re-File this document” located under EACH returned document. There you can attach your corrected PDF and re-file it.
Filing Exhibits
Whenever you e-file exhibits it is recommended practice to attach each Exhibit as a separate PDF. The NYSCEF System requires that a description of the exhibit be entered in the “additional information area” whenever the filer selects the document type Exhibit(s). This is in addition to the requirement that a user enter an exhibit number or letter in the appropriate field. Please do not simply re-state the Exhibit letter or number in the additional information field but instead give a short clear description of the exhibit. e.g. ” Copy of Contract “
Caption Reminder
When commencing an action, please make sure that the caption you enter on the “Add Parties” page exactly matches the caption that appears on your commencement document, including any abbreviations or redactions as required by court rule. In addition, each party name must be entered in the appropriate field. For example, names of individual parties should not be entered in the Business/Organization Name fields.
Junk/Spam Email
To ensure you receive email notifications from NYSCEF, please add EFile@nycourts.gov to your e-mail address book. This will prevent your e-mails from ending up in junk or other bulk folders.
