Local Emergency Order No. 16-FFF Pertaining To Indoor Group Fitness Classes
WHEREAS, on March 14,2020, I, J. Ryan McMahon, II, Onondaga County Executive, by the authority vested in me by the Onondaga County Charter, the Onondaga County Administrative Code, and the laws of the State of New York, declared, pursuant to Section 24 of Article 2-B of the New York State Executive Law, that the public safety was sufficiently imperiled such that a Proclamation of Emergency was declared within the territorial limits of Onondaga County, which Proclamation of Emergency has been extended; and
WHEREAS, New York maintains daily low positive test rates and the State has determined that, where applicable, local elected officials can allow gyms to reopen at 50% capacity while following rigorous safety protocols, including wearing masks at all times; and
WHEREAS, I, as Onondaga County Executive, have determined that gym and/or fitness centers, where applicable, may resume indoor classes, provided the necessaty inspection and the gym and/or fitness center is found to be in compliance; and
WHEREAS, this Order is necessary to provide continued management of the pandemic and assist in this local disaster emergency in a manner that protects the public health and promotes economic recovery; and
NOW, THEREFORE, in accordance with the authority vested in me by the Onondaga County Charter and Code, local home rule powers conferred upon local governments, and New York State Executive Law ยง24, I hereby issue Local Emergency Order No. 16 – allowing gym and/or fitness centers to resume indoor classes, where applicable, by appointment/reservation only; maximum class capacity capped at number of people that can adhere to the 6 -feet social distancing rules, but in no case more than 50% of the typical class size (i.e., leave stations, cycles, etc. vacant); classes should be scheduled to allow additional time for cleaning and disinfection in between each session, and gym and/or fitness center must keep (at least) a 14 day log or record, including contact information, of class attendees.
This Local Emergency Order shall remain in effect, where applicable, for 5 days through June 15, 2021, and will be formally renewedbythe issuanceofsuccessive 5-day Orders.
This order is necessary to safeguard the public health and welfare, and vital to assist in the disaster effort This Order is intended to be consistent, where applicable, with all laws, regulations and official guidelines, at the state and federal levels, and shall be read and interpreted in such manner.
